BAY AREA FUEGO BASEBALL

Participant Waiver, Release of Liability, Assumption of Risk & Medical Authorization

PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS LEGAL RIGHTS.

In consideration for being permitted to participate in Bay Area Fuego Baseball activities, I, as the parent or legal guardian of the minor participant identified below, acknowledge and agree to the following:

1. Permission to Participate

I give permission for my child to participate in Bay Area Fuego Baseball activities, including but not limited to practices, games, tournaments, tryouts, workouts, training sessions, camps, team events and other baseball-related activities organized, sponsored or attended by Bay Area Fuego Baseball.

2. Assumption of Risk

I understand that participation in baseball and related athletic activities involves inherent risks of injury. These risks include, but are not limited to, being struck by a baseball, bat or other equipment; collisions with players, coaches, fences or other objects; falls; sliding; running; throwing; field and weather conditions; equipment failure; physical exertion; and other risks associated with baseball, athletic training and competitive sports.

I understand that injuries may range from minor injuries to serious bodily injury, permanent disability, paralysis or death.

I knowingly and voluntarily accept and assume these risks on behalf of myself and my child.

3. Release and Waiver of Liability

To the fullest extent permitted by California law, I, on behalf of myself and my child, voluntarily release and agree not to sue Bay Area Fuego Baseball, its organizers, directors, coaches, assistant coaches, volunteers, representatives and agents for claims arising from my child’s participation in Bay Area Fuego Baseball activities, including claims arising from the ordinary negligence of the released parties.

This release applies to personal injury, bodily injury, illness, death or property damage arising out of or related to participation in Bay Area Fuego Baseball activities.

Nothing in this agreement is intended to release or waive liability that cannot legally be released or waived under California law, including liability for gross negligence, reckless misconduct or intentional wrongdoing.

4. Facilities, Tournaments and Third Parties

I understand that Bay Area Fuego Baseball activities may take place at fields, batting cages, schools, parks, tournament facilities and other locations owned or operated by third parties.

I understand that participation may also involve tournaments, leagues or events organized by third parties.

This waiver and release applies to my child’s participation in Bay Area Fuego Baseball activities regardless of the location where those activities take place. This agreement does not purport to release an unrelated third party unless that party is otherwise expressly covered by this agreement.

5. Medical Authorization

In the event of an injury or medical emergency involving my child and I cannot be reached immediately, I authorize Bay Area Fuego Baseball coaches or representatives to obtain reasonable emergency medical care for my child.

This may include first aid, emergency medical services, ambulance transportation and treatment by physicians or other licensed medical professionals when reasonably believed necessary.

I understand that Bay Area Fuego Baseball does not provide health or medical insurance for my child and that I am responsible for medical expenses incurred on behalf of my child, subject to any applicable insurance coverage.

6. Player Health and Safety

I am responsible for informing Bay Area Fuego Baseball coaches of any information that may reasonably affect my child’s safe participation in baseball activities.

I understand that I am responsible for determining whether my child is physically able to participate and for providing appropriate personal equipment required for participation.

I understand that coaches may remove a player from an activity when they reasonably believe continued participation may present a safety concern.
